Terms of Service

These Terms of Service ("Terms") govern your use of www.thesweetcreative.com.au and any orders you place with The Sweet Creative ("we", "us", "our"). By placing an order or using the site, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law. Where any provision of these Terms is inconsistent with the Australian Consumer Law, the Australian Consumer Law prevails to the extent of the inconsistency.

What we sell

We design and assemble hand-tied gift balloons made to order. Each order is custom-built from your selections (finish, palette or ribbon colour, gift contents, message). Because every balloon is made by hand, slight natural variation between orders is normal and expected.

Pricing and GST

All prices are shown in Australian dollars (AUD) and include GST. Delivery fees are added at checkout based on your delivery zone:

• Bathurst: $15
• Lithgow, Orange, Blayney or Oberon: $25
• Other locations: quoted separately, payable before we dispatch
• Pickup from Bathurst: free

We may update prices at any time. Once you've placed an order, the price you paid at checkout is locked in.

Placing an order

When you submit an order through the website, your card is charged at checkout via Stripe. We'll then confirm your details (delivery date, gift contents, finish availability) and start making your order. If anything you've requested isn't available — for example, a specific foil topper design or a colour we don't currently stock — we'll contact you to confirm an alternative or arrange a refund.

An order is binding on us only once we've confirmed it back to you. If we can't fulfil your order for any reason, we'll refund the full amount within 5 business days.

Customisation and substitutions

Because every balloon is made by hand from current stock:

• Exact ribbon shades, latex balloon colours and gift items may vary slightly from what's pictured online. We hand-match colours to the closest stocked option on the day.
• If a specific gift item in a bundle is out of stock, we may substitute an item of equivalent value and quality. If you'd prefer not to substitute, contact us as early as possible.
• For "Tell us — custom" palette or ribbon descriptions, we'll match as closely as we can. We cannot guarantee an exact match.
• Foil topper requests are sourced on a best-effort basis from our suppliers. If we can't get the exact one, we'll suggest the closest available before making your order.

Delivery and pickup

We hand-deliver in Bathurst and surrounding towns ourselves; in most cases your order will arrive on the date you nominated at checkout. Same-week orders are accepted by phone where possible. Pickup from Bathurst is by appointment — we'll text you when your order is ready.

For deliveries outside our usual zones, we may use a third-party courier. In this case, we hand the order over to the courier in good condition and on time; once it's with them, we cannot guarantee delivery time. Helium balloons in transit are sensitive to temperature and handling.

If no one is home at the time of delivery, we may leave your order in a safe place at the address. If a safe place isn't available, we'll contact you to arrange a re-delivery (additional fees may apply).

Payment

We accept Visa, Mastercard, American Express and other cards via Stripe Checkout. We also offer Afterpay and Klarna ("pay in 4") at checkout for eligible order totals. All payments are processed by the relevant provider, who is responsible for that part of the transaction. Your card details never reach us — we only see the transaction outcome.

Cancellations, changes and refunds

For cancellations, changes or refunds, see our Refund Policy. Your statutory rights under the Australian Consumer Law are not affected by anything in these Terms.

Helium balloons and safety

Helium-filled balloons are not toys. Please:

• Keep balloons away from open flames, heat sources and direct sunlight.
• Don't inhale helium — it can cause asphyxiation.
• Pop and dispose of balloons safely once you're done. Untied balloons can be a choking or wildlife hazard.
• Supervise children with balloons; broken latex is a choking risk for under-3s.

To the extent permitted by law, we are not responsible for injury, damage or loss arising from misuse of balloons after they've left our care.

Image and IP

Photographs of completed orders may be shared on our Instagram (@thesweetcreativeau) and Facebook unless you ask us not to. If you'd prefer your order not to be photographed or shared, please tell us in the order notes or email us before delivery.

The Sweet Creative name, logo, photographs, page copy and brand elements are our intellectual property. You may share links to our website, but please don't reproduce our images or copy without permission.

Liability

Our liability for any breach of these Terms is limited (to the extent permitted by law) to the amount you paid for the affected order. We do not exclude or limit liability for fraud, gross negligence, personal injury or any matter that cannot lawfully be excluded.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top tells you when we last made changes. Changes don't apply to orders that have already been confirmed.

Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
